Terms of service
These terms govern the managed website service.
Who offers the service
Escazú Marketing is a service offered by Escazú Consulting Group. Escazú Consulting Group is the commercial name used for this service. It is not a registered company. The identification number of the person providing the service is not published on this website. It appears on the invoice when you ask for one.
The service
The service is an ongoing managed website subscription. The price is $30 for one month or $300 for one year, plus 13% Costa Rica IVA, so checkout is $33.90 or $339.00. Each paid month includes up to four 45-minute consultations and up to 40 hours of implementation. Unused consultations and unused hours do not carry forward.
The website stays available and under care only while the subscription is paid. Maintenance, security updates, and fixes come out of the 40 hours. Foundational technical SEO, core metrics, and recurring reporting also come out of the 40 hours. Growth SEO and conversion-rate work are not included.
Each template or layout is estimated at 3 hours, and that time is the boilerplate only. Each piece of content placed on a page, such as a title, a block of text, or an image, is 30 minutes on top of the template. An architecture or technology change is 12 hours. These are estimates for planning, not fixed-price packages.
How you pay
Payment is a one-time PayPal checkout. The PayPal fee is included in the checkout price. We do not receive or store your card number, and we do not charge it again automatically.
Before PayPal opens, you accept the current terms, privacy notice, and cookie notice. We store that you accepted, the time, the version of the terms, and the IP address of the request.
Your part and ours
You provide the requirements, brand assets, text, photos, decisions, and feedback in time for the work to proceed. If you supply text in only one language, the site can go live in that language. The other language is added when you supply that text.
You keep your domain, trademarks, and the content you supply. You buy and renew the domain in your own name. We own the code, the repository, and the build. They are not delivered for you to host on your own while the subscription is inactive. When the site is deleted, the text and photos you supplied are not packaged and returned.
Work is scheduled after a consultation. A change does not start the moment it is requested. There is no promise to reply, start, or finish within a set number of business days.
What is not included
The service is limited to informational websites. It does not include copywriting, translation, photography, videography, a content-management system, online stores, booking systems, payment gateways, CRM or WhatsApp automations, advertising, applications, blogs, or other complex functionality. A content-management system may be offered later as a separate extra.
We may refuse a request that would turn the work into an application, a blog, or other complex functionality.
Consultations
Cancelling less than 24 hours before the start does not return that consultation credit. Rescheduling keeps the credit.
If you are not present within 15 minutes, we leave. The consultation is cancelled and that credit is not returned.
If a payment fails
You are notified before the public site is taken offline. If the payment is still missing after that notice, public access is discontinued. For 90 days the repository is kept and the service can be restored at no charge. On day 91 the repository and build artifacts are deleted. Invoices and payment records are kept for 5 years.
Refunds
The fee is not refunded once a consultation, backlog work, a project brief, or engineering has started. An unpublished site, a missed reply, or a missed start time is not, by itself, a reason for a refund.
If we fail to perform without an excuse, the claim is handled individually under Costa Rica Law 7472. A minor delay does not return the fee. It is made up with extra hours or a service credit, in proportion to the impact.
While PayPal is reviewing a dispute, the paid period stays. The site is not taken down only because a dispute was opened. A refund, or a dispute decided for you, ends the paid period, and the site then follows the failed-payment rule.
Infrastructure
Hosting on a provider’s free tier is used where it is enough. Usage above that tier is billed to you at the provider’s actual cost. When that bill is sent is agreed at the start of the project. If that cost is not paid, the site can be suspended.
Until invoices are issued automatically, an invoice is prepared by hand in Hacienda’s free TicoFactura tool when you ask for one. The invoice shows the provider’s identification. You can give your own ID type, ID number, legal name, email, and address for that invoice. Those details are optional if you do not want an invoice, and they are not published on this website.
Closing your account
You can ask us to close your account from the portal. We close the login. The closure is not instant and is not an automatic wipe. Invoices, payment logs, and the record that you accepted the terms stay for 5 years.
